Terms of Service

1. Acceptance of these Terms

Zyryn ("Zyryn", "we", "us", or "our") is a media application and website operated by Zyryn LLC, a New Mexico limited liability company. These Terms of Service ("Terms") form a binding agreement between you and us and govern your access to and use of the Zyryn apps, website, and related services (together, the "Service").

By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms, our Privacy Policy, our Refund Policy & EULA, and our Cookie Notice. If you do not agree, do not use the Service.

2. Eligibility & age

You must be at least 18 years old to create a Zyryn account and use the registered account features of the Service. You are responsible for your account and for any profiles you create or manage under it.

Zyryn supports managed "kids" profiles. A kids profile is created and controlled by an adult account holder and is not a separate registered account. The account holder is responsible for any kids profile they create and for supervising its use. We rely on the account holder, not the child, to provide consent. See the Children section of our Privacy Policy.

3. Your account

• You agree to provide accurate information and to keep it up to date.
• You are responsible for keeping your password secure and for all activity under your account.
• Notify us promptly at support@zyryn.com if you suspect unauthorized use.
• You may not share, sell, or transfer your account, and you may not use someone else's account without permission.

4. Premium, trials & billing

The core Zyryn app is free. Zyryn Premium is an optional paid subscription that unlocks additional features. By starting a subscription you authorize us and our payment processor to charge the applicable fees.

• Free trial. Premium may include a free trial (currently 7 days). If you do not cancel before the trial ends, the subscription converts to a paid plan and the first period is charged automatically.
• Auto-renewal. Subscriptions renew automatically at the end of each billing period (monthly or yearly) at the then-current price until you cancel. The lifetime plan is a one-time purchase and does not renew.
• Cancellation. You can cancel at any time through the billing provider that processed your purchase. Manage direct subscriptions from your Zyryn account, App Store subscriptions from Apple Account settings, Google Play subscriptions from Google Play, and Amazon Appstore subscriptions from Amazon's subscription settings. Cancellation stops future renewals; your Premium access continues until the end of the current paid period.
• Payments. Payments are handled by third-party payment processors. Stripe processes direct purchases, while Apple, Google, or Amazon processes purchases made through its app store under that store's terms. We do not receive or store your full card details.
• Refunds. Cancellation and refund terms are described in our Refund Policy.
• Price & tax changes. We may change prices and features. We will give reasonable notice of price changes; they apply to the next billing period. Prices may exclude taxes, which are added where required.

5. Acceptable use

You agree not to:

• Use the Service to infringe copyright or any other right, or to access, stream, download, or distribute content you are not legally entitled to;
• Reverse engineer, decompile, scrape, or attempt to extract source code or data except as permitted by law;
• Interfere with, overload, or disrupt the Service, or bypass any security or access controls;
• Resell, sublicense, or commercially exploit the Service without our written permission;
• Upload malware, or use the Service to harass, abuse, or harm others;
• Post list text, profile names, reports, or Watch Party messages that are unlawful, threatening, hateful, sexually exploitative, pornographic, deliberately deceptive, or that promote self-harm, violence, harassment, or abuse;
• Impersonate another person, disclose another person's private information, send spam, or evade a block, room removal, content screen, or moderation action;
• Use automated means to create accounts or evade rate limits or restrictions.

User-submitted text may be screened before it is posted. Community Lists and Watch Party participants include tools to report content or conduct and to block abusive accounts; Watch Party hosts can also remove participants. We may quarantine or remove content, restrict features, or suspend accounts when a report or our review indicates a violation. To report an urgent safety concern outside the app, email support@zyryn.com.

6. Content & third-party sources

Zyryn displays movie and TV metadata (titles, artwork, descriptions, ratings) provided by third parties. The built-in catalog uses records and media from a Library of Congress selection identified as public domain in the United States. Rights can differ in other countries, and the Library's item records and rights guidance remain authoritative for each work.

TMDB metadata is available only if you connect your own TMDB API Read Access Token and is subject to TMDB's terms and any license required for your use. Zyryn does not provide that license. This product uses the TMDB API but is not endorsed or certified by TMDB.

• Add-ons & external sources. Add-ons are provided by you or by third parties, not by us. We do not control, endorse, verify, or take responsibility for any add-on or the content it resolves. You are solely responsible for the add-ons you install and the sources you use, and for ensuring they are lawful in your jurisdiction.
• Local media. Files you add from your own device or network remain yours. You are responsible for having the rights to those files.
• We may disable or remove access to any source, add-on, or feature at our discretion, including to comply with law or protect the Service.

7. Copyright & DMCA

We respect intellectual property rights and expect users to do the same. If you believe content surfaced through the Service infringes your copyright, send a notice to support@zyryn.com including: (a) identification of the copyrighted work; (b) identification of the material and where it appears; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and (f) your physical or electronic signature.

We will respond to valid notices and may remove access to infringing material and terminate repeat infringers' accounts.

8. Our intellectual property

The Zyryn name, logo, app, website, and their design and software are owned by us or our licensors and are protected by law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use. The full software license is set out in our End User License Agreement.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any third-party content or source will be available, accurate, or lawful.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50. Some jurisdictions do not allow these limits, so they may not fully apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless Zyryn LLC and its officers, employees, and agents from any claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your content or add-ons, or your breach of these Terms.

12. Termination

You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Sections that by their nature should survive termination (such as intellectual property, disclaimers, liability limits, and indemnity) will continue to apply.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you. Continued use of the Service after changes take effect means you accept the revised Terms.

14. Governing law & disputes

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New Mexico will have exclusive jurisdiction over any dispute, except where mandatory consumer-protection laws give you the right to bring proceedings elsewhere. Nothing in these Terms removes statutory rights you have as a consumer that cannot be waived.
